15.04.2022Tax changes for the period of martial law – video tips

Dear colleagues, we continue a series of videos that can help in the difficult time.

On March 17, 2022, the Law of Ukraine “On Amendments to the Tax Code of Ukraine and Other Legislative Acts of Ukraine Concerning the Effect of Norms for the Period of Martial Law” № 2120 – IX of March 15, 2022 (“Law 2120”) entered into force. Law 2120 and other normative documents have made significant changes to the taxation rules in Ukraine in connection with martial law.

It is summarised that the changes concern the following innovations:

  • it is allowed to conduct actual tax audits on any issues and cameral tax audits on budget VAT refunds (i.e., the moratorium imposed in this on all audits has been partially lifted);
  • a moratorium on inspections for payment of ERUs was established;
  • introduced a tax of 2% of turnover for businesses (a new format of the single taxation of the third group) as an alternative to paying VAT and profit tax for companies and individuals with a turnover up to 10 billion UAH per year;
  • it is allowed to form the VAT tax credit without registered tax invoices (provided that they are registered after the end of martial law)
    the excise tax on fuel supply was abolished;
  • it is allowed to apply sanctions for violation of the procedure of settlement transactions in the sale of excisable goods;
  • it is permitted not to accrue ERUs to individuals who are single taxpayers;
  • some changes were made in the taxation issues of giving or receiving charitable assistance, and several other taxation issues were regulated.
