On February 22, 2022, Corporate Governance Professional Association (CGPA) held a regular online conference on “Anti-corruption compliance today and tomorrow: sharing the experience of compliance officers.<\/strong><\/em>“<\/p>\n

Oleksandr Okuniev, Chairman of the CGPA Management Board,\u00a0 moderated the discussion.<\/p>\n

<\/strong><\/p>\n

Serhiy Derkach,<\/strong> Head of the NAPC’s Prevention and Detection of Corruption Department, reviewed the Professional Standard of the Anti-Corruption Commissioner, emphasizing that it is the foundation of the profession. Also, S. Derkach noted eight labor functions of the anti-corruption commissioner, namely: organization and control of anti-corruption activities in the organization; coordination in bodies, enterprises, institutions and organizations belonging to the sphere of management (if any); informing and raising awareness on compliance with anti-corruption legislation; corruption risk management in the organization; conflict of interest prevention; ensuring declaration.<\/p>\n

\u00a0Oleg Polishchuk, <\/strong>a member of the Board of the National Association of Anti-Corruption Compliance, shared his findings on the theory and practice of whistleblower protection in Ukraine, namely the successes and failures. In his presentation, O. Polishchuk noted which documents and provisions regulate the protection of whistleblowers, including international conventions ratified by Ukraine and Ukrainian laws, which enshrine provisions on the protection of whistleblowers. Oleg also gave several examples of cases related to the protection of whistleblowers.

Gleb Bakalov<\/strong>, Chief Compliance Officer of NEC Ukrenergo, shared his thoughts on what awaits Ukrainian compliance in the coming years. He noted that in his opinion, the traditional formal (check the box) approach to compliance is no longer enough, and compliance officers of the future should shift the focus towards the development of ethical culture. Learn to measure it and use it as a benchmark to evaluate the effectiveness of its activities.<\/p>\n

Compliance officers should work on the development of their own soft skills (empathy, argumentation, persuasion, leadership skills, leadership); must know English to focus on the latest developments in the field of compliance (DOJ Evaluation of Corporate Compliance Programs Guidance); cultivate less bureaucracy, as well as build trust and fight cynicism in the company.<\/p>\n

Andriy Kirmach, <\/strong>Senior Director, Head of Corporate Compliance, Centessa Pharmaceuticals, in his presentation showed the place of compliance in the system of standards and principles of ESG (Environmental, Social, Governance), and noted why compliance and anti-corruption compliance are now so important in the companies of public and private sectors.
