Business development is very often connected with access to new markets, both domestic and foreign. In this process, the issues of reputation and anti-corruption compliance help avoid reputational risks. <strong>On June 4<\/strong>,<strong> 2020, <\/strong>the Corporate Governance Professional Association held an online conference to answer the question, &#8220;What&#8217;s new in anti-corruption compliance?&#8221;<\/p>\n<p style=\"text-align: justify;\">Among other things, the following issues were considered: from anti-corruption compliance to &#8220;ethics and compliance&#8221;; new context and new &#8220;good practices&#8221; in connection with the pandemic; assessment of corruption risks in work with foreign markets; the results of a study of anti-corruption compliance among the most significant participants in government tenders.<\/p>\n<p style=\"text-align: justify;\"><strong>Oleksandr Okuniev<\/strong>, Chairman of the CGPA Management Board, opening the event, stressed the importance of compliance in today&#8217;s fast-changing business world.<\/p>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" loading=\"lazy\" data-id=\"10180\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/3_300-300x206.png\" alt=\"\" width=\"300\" height=\"206\" class=\"size-medium wp-image-10180 alignright\" \/>Serhiy Derkach<\/strong>, Head of the Department for Prevention and Detection of Corruption (of the National Agency on Corruption Prevention &#8211; NACP), told the participants about the priority areas of cooperation of the National Agency on Corruption Prevention. He also spoke about the ongoing work on verifying declarations, as well as the whistleblower portal. S.\u00a0Derkach stressed that the large and powerful private Ukrainian business has much more experience in implementing an anti-corruption compliance system, so the NACP is ready for dialogue and open to proposals in the process of establishing a proper anti-corruption compliance system in all areas.<\/p>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" loading=\"lazy\" data-id=\"10181\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/4_300-300x203.jpg\" alt=\"\" width=\"300\" height=\"203\" class=\"size-medium wp-image-10181 alignleft\" \/>Ekaterina Lysova<\/strong>, Program Manager in the Eurasia Region of the Center for International Private Enterprise (CIPE), emphasized the peculiarities and uniqueness of the Program for Training of Commissioners for the Implementation of the Anti-Corruption Program (Compliance Officers) conducted by CGPA since 2016 in cooperation with CIPE. K.\u00a0Lysova drew attention to the problems faced by the modern world. But with them come new opportunities for companies in Eastern and Central Europe and Central Asia. Due to logistical constraints, most companies now have the opportunity to deepen and expand cooperation with foreign partners. Business ethics and anti-corruption compliance are standards that should facilitate and help establish collaboration. <img decoding=\"async\" loading=\"lazy\" data-id=\"10182\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/5_300-300x205.png\" alt=\"\" width=\"300\" height=\"205\" class=\"size-medium wp-image-10182 alignright\" \/>Kateryna also spoke about the latest changes to the requirements for corporate compliance programs:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Effective compliance program &#8211; not a program &#8220;on paper&#8221; or a simulation of the program, but a real functioning program;<\/li>\n<li>The program must be designed for each company, and the company must decide for itself what it needs;<\/li>\n<li>The program should be proportionate to the company&#8217;s risks and reviewed regularly.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" loading=\"lazy\" data-id=\"10173\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/7_300-300x204.jpg\" alt=\"\" width=\"300\" height=\"204\" class=\"size-medium wp-image-10173 alignleft\" \/>Oleg Boyko<\/strong>, an independent consultant on corporate governance, risk management, ethics, and compliance (GRC), a lecturer in the Training Program for Anti-Corruption Program Officers (compliance officers), said that compliance today includes three components &#8211; regulatory, ethics and organizational culture, internal policies and procedures. O.\u00a0Boyko told what the sphere of anti-corruption compliance looks like today and noted that compliance is evolving, and approaches to implementing a proper anti-corruption compliance system in companies are also subject to change and development. As a result, the \u0421ompliance Officer Training Program has also changed accordingly compared to 2016.<\/p>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" loading=\"lazy\" data-id=\"10174\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/8_300-300x205.jpg\" alt=\"\" width=\"300\" height=\"205\" class=\"size-medium wp-image-10174 alignright\" \/>Pavlo Verkhnyatsky<\/strong>, Director of COSA, an expert in information and analytical support of business security in the international aspect, noted that for Ukrainian companies reorienting to new markets, entering into business relations with partners from the EU and the US, the issue of corruption risks is becoming increasingly important. Attention to the reputation of its counterparties in developed countries has increased due to strict regulations and, consequently, domestic corporate policies. At the same time, when entering emerging markets where corruption is still significant, Ukrainian companies should be just as cautious, as reputational gaps in some jurisdictions in the context of globalization become apparent and create problems in others. The expert advises that it is crucial to consider and assess national\/regional risks on the one hand, and sectoral risks on the other, which sometimes arise in very unexpected places. He also noted that the level of political corruption and the specifics of the financial \/ banking sector should not be overlooked to protect the company from the money laundering schemes.<\/p>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" loading=\"lazy\" data-id=\"10184\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/10_300-300x205.jpg\" alt=\"\" width=\"300\" height=\"205\" class=\"size-medium wp-image-10184 alignleft\" \/>Oleg Lagodiyenko<\/strong>, co-founder and executive director of Ethicontrol. With Ethicontrol, Oleg helps clients improve business culture and ethics, corporate security, implement compliance programs, and combat fraud. Oleg shared the results of the study of the winners of tenders carried out through the system &#8220;Prozorro.Sales&#8221;. The subject of the inspection was the compliance of the TOP-30 winners of tenders of the law on public procurement, namely the clause on the existence of an anti-corruption policy or program, as well as the Commissioner For the Implementation of the Anti-Corruption Program. Also, the availability of the winner&#8217;s official website, anti-corruption program (document), hotline, documents on the appointment of the commissioner, contacts of the commissioner were taken into account. The results of the study were impressive: four of the TOP-30 do not have an official website, only 18 out of 30 have orders appointing a commissioner, in which only four indicate his contacts; 14 hotlines were established, but only eight were identified, four of which were without contacts, and two hotlines were only internal.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" loading=\"lazy\" data-id=\"10175\" src=\"https:\/\/cgpa.com.ua\/wp-content\/uploads\/2020\/06\/9_1_300-300x205.png\" alt=\"\" width=\"300\" height=\"205\" class=\"size-medium wp-image-10175 alignright\" \/>Summing up the event, <strong>Oleksandr Okuniev<\/strong> stressed that a series of online conferences on anti-corruption compliance is planned for the summer and announced preparations for the next event, where representatives of law firms will speak, and for those who want to improve their knowledge of anti-corruption compliance and gain practical skills, offered to take part in the Training Program for Compliance Officers, which will take place on July 27-31, 2020.<\/p>\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>First of all, the crisis should be considered an opportunity for development, for finding new ways for growth.
